A MAN was caught drink-driving in his works van after celebrating his birthday the night before.

Nicholas Fox, 49, of Allan Park, Hill of Beath, appeared in the dock at Dunfermline Sheriff Court.

He admitted that on August 4, at High Street, Cowdenbeath, he drove a van after consuming excess alcohol.

His reading was 55 microgrammes of alcohol in 100 millilitres of breath, the limit being 22 microgrammes.

Depute fiscal Jill Currie said the incident occurred at 6.45am. A witness who spoke to Fox thought he was slurring his words and the police were contacted.

Defence solicitor James Moncrieff said his client had been drinking the night before to celebrate his birthday.

He got up and drove to work the next morning which was “an error of judgement”.

“It was his works vehicle he was driving and he lost his job as a result. He’s now unemployed,” added the solicitor.

Sheriff Kevin Veal imposed a community payback order with 80 hours of unpaid work and a 15-month driving ban.
