A COURT hearing will take place early next year after a dispute between a Cowdenbeath dairy and Fife Council turned sour.

Graham’s The Family Dairy are appealing noise abatement notices which were served after local residents complained about constant noise coming from the generators at its Glenfield Industrial Estate premises.

Evidence is due to be heard at Kirkcaldy Sheriff Court on January 28.

Local council Alex Campbell has been trying to help find a resolution for the good of all parties involved.

He said: “The members of the community contacted me to see if I could help them regarding external generators which are working 24 hours a day.

“People cannot get a sleep. Graham’s have been doing some noise reduction to generators which has reduced the noise a bit but people are still having sleepless nights.

“I have spoken to Graham’s and asked for further improvements and also to Scottish Power.

"People should still be able to go to bed at night and sleep."

Graham's have confirmed that they are appealing the action taken by Fife Council.

Managing director Robert Graham said: "Noise abatement notices have been served. We contest the basis for these notices raised by Fife Council and have achieved the only recourse available, which is to appeal to this situation. 

"As a family dairy business we rescued Glenfield in 2015 and have secured its future through huge investment, safeguarding and creating over 150 local jobs.

"We have addressed these issues raised and therefore consider these notices to be unwarranted.

"We will continue to work with our neighbours, Fife Council and Scottish Power to deliver this significant investment for Cowdenbeath and the district of Fife."

Nigel Kerr, Fife Council's interim chief officer in protective services, said: “Legitimate concerns have been raised about the operation by neighbours, particularly with regards to noise.

"These are being investigated and we’d like to assure residents that we’re taking appropriate action.

“Related court cases are current and the Sheriff at Kirkcaldy fixed a hearing on the evidence to take place on 28 January 2020. 
"No further comment can be made at this stage.”
