A MAN who exposed himself and shouted racist abuse outside a Ballingry takeaway has received a jail sentence.

Liam Kinch, 24, had previously been placed on a community payback order for his bad behaviour outside Sizzlers Takeaway, however, after a review of it at Dunfermline Sheriff Court on Wednesday, this was revoked.

Sheriff James Macdonald said he had breached the order by committing another offence – which he has been in prison for since March last year and had been due out of custody on Friday – and jailed him for another three months.

Depute Fiscal, Jane Doig, said Kinch, had come from a flat opposite the fast food premises where he had previously been hanging out of the window and randomly shouting and swearing.

"For some reason he pulled his trousers down to his ankles exposing his genitals in the middle of the street," she told the Court. "He then jumped on the bonnet of a car."

Kinch could be heard shouting "you black Hindu b******" which caused distress to the woman, who remained in her car throughout the incident.

Still with his trousers down, he then placed his naked bottom on the windscreen of the vehicle before making thrusting motions towards the window.

He eventually jumped down from the car and pulled his trousers back up.

Kinch admitted that on July 16, 2017, at Sizzlers Takeaway, he committed an offence of public indecency by exposing his genitals and making thrusting motions, placing his naked buttocks on the windscreen of a car and seizing his genitals and making suggestive remarks.

He also acted in a racially aggravated manner which caused, or was intended to cause, alarm and distress to a person by shouting, swearing and uttering racist remarks.

Solicitor, Ian Beatson, said his client had sought solace in alcohol following the death of an uncle.

He added: "On the day in question, he had far too much to drink. He has no idea why he acted in this manner."

Sheriff James Macdonald told Kinch he had to revoke the community payback order which had been previously imposed as a direct alternative to custody.

He added: "Having heard the narration of the facts, I am entirely satisfied that no other method of dealing with you would be appropriate other than a custodial sentence. I will take into account the fact you completed some of the hours of unpaid work."
