A GOOD Samaritan was kicked and punched in an assault in Dunfermline town centre.

The incident happened in Maygate and resulted in a court appearance for security officer Arkadiusz Gorski.

Appearing for sentencing at Dunfermline Sheriff Court yesterday (Wednesday), he had previously admitted that on December 1, he assaulted a man by punching him to the ground and repeatedly punching, kicking and stamping on his head to his injury.

He also admitted a further offence of failing to appear at court on August 17.

The court saw CCTV coverage of the assault and depute fiscal Dev Kapadia said Gorski, 23, of High Street, Lochgelly, appeared to be having an argument with his partner and, at around the same time, the victim was getting out of his car and witnessed this.

"He then goes to act as a Good Samaritan," he told the court. "He is then seen being assaulted, kicked and punched and repeatedly kicking."

Although not seriously injured, the man complained of soreness mainly to his shoulders and upper body.

"He was lucky he didn't sustain any serious injuries," added Mr Kapadia.

Solicitor Stephanie Clinkscale said her client accepted that it was a serious crime. "He accepts that it is completely unacceptable behaviour," she added.

Sheriff Chris Shead said it had been a "serious" offence.

"The court has to address the question of whether or not custody is the only inappropriate disposal and I have come to the conclusion it might not be the only appropriate disposal," he told Gorski.

He placed Gorski on a community payback order with 12 months' supervision. He will also have to carry out 300 hours of unpaid work within nine months and pay £750 of compensation to his victim.
