A MAN who spat in a female's face as she walked from Harlem nightclub in Dunfermline has appeared in Court. He was also involved in a Lochgelly disturbance.

In an intoxicated state, Sean Matthew mistakenly thought the woman was laughing at him.

Matthew, 20, of Valley View, Kirkcaldy, admitted that on March 26 last year in Bruce Street, Dunfermline, he assaulted a female by spitting on her head.

He also admitted that at Buller Street, Lochgelly, on November 22, 2015 he recklessly damaged a door by kicking it.

Matthew also admitted breaching bail curfew conditions on October 1 last year.

Depute fiscal Alisdair Shaw told Dunfermline Sheriff Court: “The complainer and a friend had been at Harlem nightclub.

“They had gone outside and were walking towards the traffic lights at Carnegie Drive.

“At this point the accused made his way towards both women and for whatever reason spat directly in her face.

“This was an unprovoked assault. He had been drinking and was under the influence of alcohol.”

The Lochgelly incident occurred at around 2.45am.

Mr Shaw said: “The accused had returned to a friend’s house where he had previously been drinking. He had been asked to leave because of his behaviour.

“He returned and a disturbance ensued. He kicked the door open, damaging it.”

Defence solicitor Sarah Meehan said: “He had consumed a significant amount of alcohol and has a fairly limited recollection of both incidents.”

He had gone to a nightclub in Dunfermline with friends but had been ejected from it and was separated from his friends as a result.

The females were “laughing and he thought incorrectly they were laughing at him and reacted in that manner.”

The Lochgelly incident occurred when he had gone to a party at “a friend of a friend’s home”.

“He left and returned to retrieve his mobile phone but was refused entry and damaged the door. Again he’s not proud of his actions,” said Ms Meehan.

Sheriff Charles MacNair told Matthew, “These are serious offences. Spitting in the woman’s face is quite disgusting.”

He imposed a community payback order with 270 hours of unpaid work and £400 compensation for the Dunfermline incident.

Matthew was placed a restriction of liberty order for 108 days for the Lochgelly offence to run consecutively with an existing order.

He was also fined £675 for the breach of curfew conditions.
