A MAN has been refused bail for challenging others to fight after a family matter got out of hand.

The incident began when Jamie Brown's mother asked him to search for his nephew when she realised he was breaking his restriction of liberty order that required him to be home by 7pm.

Dunfermline Sheriff Court heard on Wednesday that at around 10pm some residents of Main Street, in Cardenden, could hear shouting and noise coming from outside and contacted the police.

Brown was seen with around seven or eight other peers, shouting and swearing and challenging others in the group to fight.

It was noticed that his nephew was in the possession of a knife but the accused had no contact with the weapon.

When police arrived, officers noticed that he was under the influence and charged him.

Brown, 32, of no fixed abode, did previously admit that on August 13 at Main Street, Cardenden, acting along with another did behave in a threatening or abusive manner which was likely to cause a reasonable person to suffer fear or alarm in that he did shout, swear, utter threats of violence and challenge others to a fight.

Defence solicitor, Ms Joiner, told the Court that her client has mental health problems that he has been trying to battle himself but is now asking for help.

"Mr Brown is maybe the minor player in this matter and his nephew is pleading guilty,” she said.

"He found his nephew in a pub after his mother asked to search for him and he appeared to be getting into an altercation and there may have been punches thrown.

"Mr Brown was punched on the face and he reacted. Both went back to the house but the youths followed them.

"He foolishly went back outside when he should have stayed inside."

Sheriff Craig McSherry deferred sentencing until November 1 for reports and Brown was remanded in custody.
