A LOCHORE man was told he was on the threshold of custody after he carried out a drink fuelled assault after a night out.

Kyle McCormack, 21, of Waverley Place, appeared for sentencing at Dunfermline Sheriff Court on Wednesday after previously admitting assaulting a man in Foulford Place, Cowdenbeath on August 27 by repeatedly kicking and punching him on the head and body.

On the same date, he also assaulted a woman by seizing her by the hair and pulling it.

Depute fiscal, Jennifer Graham, said the two victims had been out with the accused and they had all been drinking.

They returned to the woman's address at around 2am and heard McCormack banging around hours later. When they went to investigate what was happening, McCormack became violent.

He grabbed the female witness by her hair and pulled her to the ground before punching and kicking the man repeatedly.

Solicitor, Barbara Collie, said her client had been invited out to celebrate the man's birthday.

"He accepts he drank more alcohol than he normally does," she said. "He returned there and went to bed and an argument started."

Sheriff Christopher Shead said he was prepared to contemplate a non custodial sentence for the last time.

"You are on the threshold of custody," he said.

"I am told your attitude has undergone some reassessment on your part."

He placed McCormack on a community payback order requiring him to do 160 hours of unpaid work within six months.
