A NEIGHBOUR was assaulted and hit with racist remarks after he confronted a teenager who kicked and punched the wing mirrors of a parked car.

The assaulted man and his friends heard a commotion outside on Rosewell Drive, in Lochore, and saw Christopher Roberts walking past the window punching the wing mirror of his partner's car.

Depute fiscal, Jade Doig, told Dunfermline Sheriff Court on Wednesday: "People shouted at the accused asking what he was doing. He apologised, saying he would pay for the damage he'd caused. The teen had also cut his hand.

"Roberts then tried to get in his house but was refused by his step-father. The complainer was still at scene and things became heated."

The teenager then swore and made a racist comment to the victim, before he punched him on the left side of his face.

The victim grabbed Roberts but immediately let him go and the teen then walked back to his home address.

Roberts ended up damaging another vehicle by punching the side panel before running away.

When Police detained and interviewed the Roberts he said he was sorry for everything he'd done, but he was 'more sorry for being racist than anything else'.

Roberts, 18, previously admitted that on June 23 at Netherton Road, Cowdenbeath, he did behave in a threatening or abusive manner which was likely to cause a reasonable person to suffer fear or alarm in that he did shout swear and threaten violence.

Also on June 23, at Rosewell Drive, he did assault a man and did punch him to the face, without reasonable excuse wilfully or recklessly destroy or damage the property belonging to another and did punch and kick the wing mirrors of a vehicle.

Furthermore, he did without reasonable excuse, wilfully or recklessly destroy or damage the property belonging to another and did punch the side panel of a vehicle, and did act in a racially aggravated manner which caused or was intended to cause alarm and distress to a person.

He also previously admitted that having been granted bail on June 26 and being subject to the condition to remain within his bail address between the hours of 2100 and 0700 and to attend at the door to officer from Police Scotland, did on July 9, at 46 Rosewell Drive, fail without reasonable excuse to comply with said condition in respect that he did not attend at the door of his domicile of citation at 0200 hours when police officers attended.

Defence solicitor, Linsey Margo, said: "Mr Roberts lives with his mother. He had been out with friends drinking and had blanked out.

"He cannot remember anything. It was only when he sobered up he realised what he had done.

"He is a young man who has issues with his temper and alcohol and is in long term employment."

Sheriff Derek Reekie told Roberts: "You are a young man and and again you find yourself in court. It seems that this is an emerging pattern.

"The racial aggravation is particularly unpleasant but you did apologise for your behaviour when you sobered up. I am willing to give you another chance as an alternative to custody."

Roberts will serve a community payback order of 160 hours of unpaid work and 18 months supervision. He was also ordered to pay £200 in compensation.
